The terms and conditions regulate the legal relationship between you and TStravelselection as organiser. Your contract will be with us as tour operator, unless you have booked a locally operated trip, in which case your contract for tour services will be with the relevant local operator and will be subject to that local operator’s terms and conditions, in addition to the booking conditions set out below. In the case of mediated services by third parties such as package tours from other tour operators or individual services such as flight tickets, rental cars, or hotel accommodation you contract directly with the relevant companies. For any Locally Operated Trip, the local operator will also be identified on your itinerary or travel documents and their respective terms and conditions will be available directly on their websites or by contacting them. Should we book a flight on your behalf it will be subject to the conditions of the respective airline, including but not limited to deposit/full payment and cancellation terms. Please read all booking conditions carefully. By making a booking with us, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions and any additional terms and conditions as indicated above and/or at the time of booking. We reserve the right to change these terms and conditions at any time prior to you making a booking request. “You” and “Your” means all persons named in a booking (including anyone who is added or substituted at a later date). “We”, “us”, “our” and “organiser” means TStravelselection.
CONCLUSION OF CONTRACT
1. BOOKINGS AND CONCLUSION OF CONTRACT
The contract between you and the tour operator comes directly to accept your written, telephone or personal registration organizer. A booking request is accepted when we issue a written booking confirmation and you have paid your deposit. From that point on, the rights and obligations from the contract effective for you and the organiser. If you register additional travel participants, you are responsible for their contractual obligations.
2. SERVICES
The scope of the contractual services results from the service description on our website as well as the information in the travel confirmation. Ancillary agreements (changes, additions, special requests etc.) require express written confirmation from the organiser. The services we provide to you are limited to the arrangement and coordination of your travel arrangements and the delivery of travel arrangements which we directly control. This includes work undertaken prior to travel to arrange and coordinate the delivery of your travel arrangements.
3. PERSONAL DATA
By booking you agree that the organiser collects personal data such as address, telephone number, email address, passport data, health data or special eating habits, if necessary, to service providers (e.g., airlines or local agencies). For security reasons, airlines and our overseas suppliers require names to be given exactly as stated in your passport. If you do not advise the correct information and we have to re-issue airline tickets or other documentation, then you will be responsible for any fees charged (such as airline cancellation charges or re-issue fees) in addition to our own reasonable administration fees. Special dietary requests are required to be notified to us at the time of booking. As in Europe there are special seats for children, please inform us if any of the passengers are younger than 12 years and if so, how old they are. If this information is not shared with us, we cannot be hold responsible for the extra costs or any eventuality that may arise for this reason.
PRICES AND TERMS OF PAYMENT
1. PRICES
The prices for travel arrangements can be found on the website, price list or offer. They understand each other if nothing else mentioned is in Australian Dollar. The price includes accommodation, transportation, and other inclusions as per the published itinerary. International and domestic are not included unless specifically stated. Costs associated with passports, visas, vaccinations, insurance, meals (other than those stipulated), emergency evacuation costs, gratuities, and all items of a personal nature are not included.
2. CREDIT CARD FEES
Credit card payments attract a service fee. When paying by credit card the organiser or tour operator will pass on the surcharge to you.
3. PRICE SURCHARGES
We reserve the right to surcharge the cost of your booked travel arrangements prior to commencement for circumstances beyond our control such as currency devaluation, fuel or air fare surcharges, or the imposition of new or amended Government charges.
4. SERVICE FEE & DEPOSIT
In addition to the prices mentioned on the travel offer, the tour operator raises additional service fees for reservation, processing, and advice. A 10% deposit is required within 7 days after accepting your booking. This deposit is non refundable. The deposit payable to us is for services associated with the processing and confirmation of your booking on travel arrangements that we may provide to you. Because these services are provided as soon as we confirm your booking, the deposit is non-refundable. This deposit is in case of cancellation of the trip non-refundable. We may not hold any services for you until we receive payment of your deposit, meaning that services may become unavailable, or prices may increase, in which case you will be responsible for paying the increased price, and we will not be responsible if services become unavailable.
5. FINAL PAYMENT
All reserved services require payment in full prior to arrival date. Payment in full must be received by no less than 60 days before commencement of your trip. Private and/or customised tours, self-drive tours, excursions, transfers, hotels, train tours and getaways require 40% payment 120 days prior to arrival and 60% payment 60 days prior to arrival. We are under no obligation to remind you of a payment becoming due. If we fail to receive a payment from you by the due date for payment in clear funds, then this will be deemed a cancellation by you. Note: some trips may require payment (including full payment) earlier or in additional instalments and this will be advised with the booking confirmation. In the case of short-term bookings, the entire amount must be paid when the contract is concluded. The balance is to be paid no later than 60 days before departure. Not entitled to timely payment the organiser to refuse the travel service. Airline tickets are at the time of ticketing payable. You acknowledge that we may not be able to confirm services, in which case we will provide you with a refund.
6. GENERAL PAYMENT CONDITIONS
In the event advance payments or the total respectively remaining amount is not paid by client within the period agreed upon, TStravelselection may refuse performance and withdraw from the contract. In such event, TStravelselection shall invoice client cancellation costs in accordance with the term “Cancellations”.
REBOOKINGS AND CHANGES BY THE TRAVELLER
1. REBOOKING
All rebookings and changes must be received in writing. We charge a processing fee for changes (name, travel date, rebooking of accommodation or rental car, etc.) of AUD 250.00 per person. Within the cancellation periods conditions according to our cancellation policy apply.
2. EXCEPTIONS
Special rebooking and change regulations apply to flight tickets and certain land services.
3. CHANGES IN RESERVATIONS
Any change in reservations that have been previously confirmed (arrival or departure date, travel conditions, etc.) that occur longer than 4 weeks before the beginning of the trip before the planned execution of services are subject to a AUD 250.00 fee, unless TStravelselection proves having incurred higher expenses. Claims for a change of booking by the client made within 4 weeks before the planned execution of services can be honoured - if at all - only by way of withdraw from the existing booking and simultaneously place a new booking. This shall not apply to claims of changes involving minor costs only. If a passenger wishes to alter the trip significantly during the trip, any changes will need to be confirmed and a AUD 300.00 fee applies, unless TStravelselection proves having incurred higher expenses. The passenger will also be responsible for any possible costs charged by service providers as a result of his cancellations or changes.
CANCELLATION OF THE TRIP BY THE TRAVELER
1. REPORT
If you can't make your trip, you must do this to the organiser in writing. The receipt of the declaration of withdrawal is decisive. In the event of cancellation, we or the tour operators listed in the travel confirmation are entitled to appropriate compensation.
2. PROCESSING FEES
In case of cancellation or partial cancellation of a confirmed booking, we charge a processing fee of AUD 250 per person. In addition, cancellation costs are due in accordance to the following cancellation fees.

In the case of cancellation or partial cancellation of a confirmed booking, we charge cancellation costs in addition to the processing fee.
More than 60 days before departure 50%, 59-20 days before departure 80%, 19-0 days before departure or no show 100%. These conditions do not apply during fairs, conferences or events.
5. CANCELLATION FLIGHT
If a flight booking is cancelled, we charge a fee of AUD 250 per person.
The conditions apply to the issuance of flight tickets of the relevant air fare or airline. As a rule, no refunds are possible for flight tickets.
6. EVENT TICKETS
In the event of cancellation of concert, theatre, opera or sports tickets are subject to 100% cancellation charges.
7. DIFFERENT CONDITIONS
Special cancellation conditions apply to individual services or at certain times of the year/high season.
8. NO SHOW
If you miss a flight, train or ship, there is no possibility of a refund. If you are flying back, you must book another return flight at your own expense. This applies in particular even in the case of flight plan changes.
9. STOP TRAVELLING WHILE ON THE TRIP
Cancel the trip, give a vehicle earlier back or cancel individual services, no refunds can be made. If there is a refund from a service provider for services you did not use a reimbursement from us less a processing fee of AUD 250.00 will apply.
11. SUBSTITUTE NOTIFICATION
If you, as a nominated person, have to cancel your trip before 60 days of departure you can nominate a replacement who is willing to start the trip under the same conditions as per travel confirmation. This replacement person can only be appointed if all service providers involved, in particular an airline, accepts this change. In any case, a processing fee of AUD 250.00 will be charged for the replacement and in addition, fees of the service providers will be passed on in full.
CANCELLATION OF THE TRIP BY THE ORGANISER
1. CANCELLATION DUE TO FORCE MAJEURE AND OFFICIAL MEASURES
In these terms and conditions, the term Force Majeure means events beyond our control and which we could not have reasonably prevented including but is not limited to: natural disasters (including, but is not limited to, flooding, fire, earthquake, landslide, volcanic eruption, etc.), adverse weather conditions (including hurricane or cyclone), high or low water levels; war, armed conflict, industrial dispute, civil strife, terrorist activity or the threat of such acts, epidemic, pandemic; any new or change in law, order, decree, rule or regulation of any government authority (including travel advisories and restrictions). If the trip is cancelled due to force majeure and official measures the cancellation or cancellation of the trip can be made at short notice. In such cases the organiser refunds payments of travel expenses minus the costs for previous expenses - in particular travel services already used, non-refundable travel services, all service charges, costs for the previous consulting effort, as well as the order fee. Further claims for damages are excluded. If in our reasonable opinion we (either directly or through our employees, contractors, suppliers or agents) consider that your travel arrangements cannot safely or lawfully proceed due to a Force Majeure Event then, we at our discretion, may elect to: reschedule your travel arrangements (in whole or in part), and/or cancel your travel arrangements (in whole or in part), in which case our contract with you will terminate (in whole or in part). If we cancel any of your travel arrangements, neither of us will have any claim for damages against the other for the cancelled arrangements. However, we will refund payments attributable to the cancelled travel arrangements less: unrecoverable third party costs and other expenses incurred by us and our related companies for the cancelled travel arrangements, overhead charges incurred by us and our related companies relative to the price of the cancelled travel arrangements, and fair compensation for work undertaken by us and our related companies in relation to the cancelled travel arrangements until the time of cancellation and in connection with the processing of any refund. If due to Force Majeure we cancel travel arrangements after your trip has commenced, we will provide you with a refund of recoverable third party costs for cancelled travel arrangements only, less administrative fees. If we provide you with any alternative services or assistance where travel arrangements are cancelled or rescheduled due to Force Majeure, then you agree the amount to be refunded to you will be reduced by the value of these services and assistance. You acknowledge that the terms in this section are reasonably necessary to protect our legitimate business interests. We strongly encourage you to purchase travel insurance that adequately responds to cancellation and rescheduling risks associated with Force Majeure events.
PASSPORT, VISA & HEALTH REGULATIONS
You are responsible for the necessary travel documents as well for compliance with health regulations self-responsible. It is a requirement that you hold a valid passport and any required visas for your trip. It is your responsibility to ensure that you are in possession of the necessary documentation to comply with the laws and regulations of the countries to be visited. The organiser is exempt from any liability should the traveller be deported or refused entry for not meeting entry requirements or passport irregularities. The traveller will be responsible for any costs as a result of this, according to our established cancellation policies. TStravelselection accepts no liability if a passenger cannot be carried due to incomplete travel documents, non-issued visas and/or lack of health care (including vaccinations). In this case you are not entitled to a refund.
PRICE AND PROGRAM CHANGES
The organiser reserves the right to change product information, service descriptions, prices on the website on price lists. If this is the case, your booking office will inform you before the contract is concluded.
1. PRICE CHANGES
For certain cases listed below we reserve the right to increased prices published on our website and in our offers:
- Tariff changes by transport companies (e.g., fuel surcharges), newly introduced or increased fees and taxes (e.g., airport taxes), government ordered price increase or levy taxes (e.g., VAT), exchange rate changes. If the organiser changes the price, you will be informed. If the price increases by more than 8% of the originally booked total price, TStravelselection has the right to withdraw from the contract free of charge within five days of recipients of our notification in return for a full refund of your payment less the non refundable deposit.
2. PROGRAM CHANGES
The organiser also reserves this in your interest. We reserve the right to change the travel program or individual agreed services (e.g. accommodation, means of transport, activities, airlines, flight times and routes) to change if unpredictable or not avoidable circumstances require it. The organiser will inform you of such changes as soon as possible and will try to offer you an equivalent replacement service. You acknowledge that the itinerary, modes of transport, accommodation and/or the trip’s inclusions may need to change during your trip due to local circumstances beyond our reasonable control, including road conditions, poor weather, changes in transport schedules, and/or vehicle breakdowns. You agree that we have the right to pass on any costs we incur for alternative arrangements we put in place for your benefit in these circumstances. To the fullest extent permitted by law, we will not be responsible for any omissions or modifications to the itinerary or the inclusions due to Force Majeure or other circumstances beyond or control happening after we have accepted your booking. This includes any loss of enjoyment or distress caused by omissions or modifications. If you are entitled to any compensation for any modifications or omissions, then you agree it will be reduced by the value of any alternative services we provide which you accept. We will not be responsible to you for any other expenses or loss you incur resulting from any amendment or change to the itinerary or its inclusions.
HOTEL ACCOMMODATION
Most hotel rooms in Germany don’t offer air - conditioning and Internet has to be paid separately. Hotels usually offer non-smoking single and double rooms; triple and twin rooms are not standard. However, upon request an additional/separate bed may be provided. Check-in time is usually at 3 pm. and Check-out at noon. All hotels selected for the programs are subject to change. If a change becomes necessary for any reason, clients will be accommodated in hotels that are equivalent in service and price category as those listed. During holidays, conferences and special events, accommodations may only be available outside the city.
TOUR TRANSPORTATION
Transportation on our tours is conducted by car, minivan or tour bus, depending on the number of passengers. If the number of participants confirmed on a tour is small, we reserve the right to conduct transportation in a passenger vehicle or minivan driven by the guide, in order to comply with our guaranteed departure dates.
SELF-DRIVE
At the time of rental, the driver must present a valid national driver‘s licence that has been held for at least 1 year. An International Driving Permit (IDP) is highly recommended for non - European Union renters. Further a photo ID(passport etc.) along with a valid full credit card are required. Drivers should be at least 25 years of age. A surcharge for underaged drivers from 18 to 24 years will apply.
VOUCHERS
After receiving payment in full on reservations made by you (city packages, train travel, etc.) we send out the vouchers by e-mail. Our clients are required to present these vouchers at hotels or to tour guides.
ENGLISH-SPEAKING TOUR-GUIDE
Travelers will be accompanied by an English-speaking tour guide during the entire travel program if not mentioned differently (or a driver-guide, for groups up to 7 participants). All our guides have extensive experience and are specially trained for each travel program.
WEATHER CONDITIONS
Weather conditions vary and cannot be guaranteed. Parts of Germany, Austria and Switzerland are normally covered during the European winter, however snow and snowfalls can not be guaranteed.
DIETARY, HEALTH AND SPECIAL REQUIREMENT
You must clearly state all your dietary requirements at the time of booking. We cannot guarantee that special dietary requirements can be met, and we cannot take responsibility for any such requirements not being fulfilled. Walking is a fundamental part of our trips. Our trips are not suitable for people with reduced mobility. If you have a medical condition (including any mental health disorder) that may reasonably affect your trip or you require special arrangements to be put in place, you must inform us in writing at the time of booking. We may ask you to complete a medical assessment form to assist us. If we cannot reasonably accommodate your needs, or where your participation will cause unreasonable disruption to the functioning of the trip, we may decline the booking or ask for you to be accompanied by a person who is able to provide full assistance to you throughout your trip. We reserve the right to cancel your booking if any changed or non-disclosed medical conditions mean that you will require special assistance which we cannot reasonably provide. We strongly suggest that your travel insurance policy includes comprehensive cancellation coverage. We will not be liable for any damage, injury, death or loss of any kind arising from your failure to disclose relevant medical information.
LUGGAGE
Each passenger is entitled to bring one medium-sized piece of luggage, with a maximum weight of 23 kg, free of charge. Transportation of excess luggage is subject to space availability. If the excess luggage exceeds the capacity, the traveller will be required to leave part of his luggage behind or pay for extra transportation and fees. Luggage will be transported at the owner’s risk. The organisation is not responsible for loss, theft or damage to the luggage during the trip. We recommend that travellers remain present at all times when their luggage is being handled. In case of air, river or sea transportation of luggage, the specific conditions of the transportation companies apply as set out on the passenger ticket. In case of loss or damages, we recommend filing an immediate complaint with the company responsible for transportation. TStravelselection would like to remind customers that they are responsible for their belongings.
NOT INCLUDED SERVICES
Generally not included, if not mentioned differently are: Porter service, meals and beverages, insurances, tips, personal expenses, not mentioned fees.
TRAVEL INSURANCE
Travel insurance is not included in our tours. We recommend purchasing travel insurance in your home country, prior to your trip. TStravelselection is able to provide information on travel insurance options.
COMPLAINTS
In the event of disruption of your travel arrangements please make our local supplier aware of such immediately. If the services provided do not correspond to the booking description or are otherwise defective, you must contact the tour guide immediately or the service company that should perform. In that case you must, from the tour guide or from the service company that is to provide the service, request written confirmation. Complaints and any claims for damages must be made in writing no later than 30 days after your return. If you notify us of a problem during travel and we haven’t resolved it to your satisfaction, then you must make any claim in writing within 30 days from the end of your travel arrangements. TStravelselection will not address any complaints received after this time.
DISCREPANCIES
TStravelselection assumes no liability and will not consider any complaints in case of a discrepancy between written and verbally provided information and/or prices. In that case the written information applies, respectively any additional agreements, which were concluded in electronic form explicitly regarding this.
DEEMED ACCEPTANCE
If you place a booking on behalf of another party, you represent and warrant us that you are duly authorised to provide the agreement and consent of the other party to be bound by these Booking Conditions. You agree that you will be responsible for any loss or damage we incur if this is not the case.
LIABILITY FOR BROKERING THIRD-PARTY SERVICES
If TStravelselection brokers individual modular services (hotels, rental cars, transport, tours), TStravelselection is only liable for brokering the service and not for the execution of the service itself. However, we guarantee that we have carefully selected these companies.
EXCLUSION AND LIMITATION
Irrespective of whether it is a packaged tour or a modular tour, claims for damages are excluded if they are due to a failure on your part unforeseeable or unavoidable omissions a third party or due to force majeure are or if damage occurs despite due care by us or by the service provider could be foreseen or averted. The restrictions on compensation provided for in international agreements in the event of damage resulting from non-performance or improper performance of the contract remain reserved.
TERMINATION RIGHT OF TStravelselection
TStravelselection may terminate the present contract without notice in the event of individual travellers seriously disturb the travelling despite a warning by TStravelselection, or misbehave in such a manner which justifies an immediate rescission of the contract. In the event of a termination by TStravelselection, the latter is still entitled to the payment of the price.
SPECIAL REGULATIONS IN CONNECTION WITH PANDEMICS (ESPECIALLY COVID-19)
The parties agree that the agreed travel services are provided by the respective service providers are always provided in compliance with the rules and requirements applicable at the time of travel. The traveller agrees to the applicable rules - including any mandatory vaccination - to be observed. In the event of typical symptoms of illness occurring, the traveller is obliged to inform the tour guide and to inform the service provider immediately.
ACCEPTANCE OF RISK
You acknowledge that travel involves personal risks which may be greater than those present in your everyday life. This could be as a result of the adventurous nature of your trip or the visiting of destinations which present geographical, political or cultural risks and dangers. You should consult guidance issued by the Department of Foreign Affairs and Trade (DFAT) applicable to the destinations within your itinerary. You acknowledge that your choice to travel is made having had the benefit of DFAT guidance, and you accept any additional personal risks associated with your travel. To the fullest extent permitted by law, we disclaim any liability for these risks.
GENERAL
The contract between TStravelselection and you is governed by the laws of the State of Queensland. Any disputes shall be dealt with by a court with the appropriate jurisdiction in Queensland. If any provision of these Booking Conditions is found to be unenforceable, then to the extent possible it will be severed without affecting the remaining provisions.
